The Company reserves the right to request removal or modification of any Ambassador content in its sole discretion.
Disclosure
The ambassador agrees to disclose the material connection between them and the Company.
The ambassador may use text such as #SKBambassador, #sponsored, or “#ad” to disclose this relationship.
The disclosure should be clear and follow all guidelines by the Federal Trade Commission (FTC)
If you sign up by entering into an Ambassador Agreement and receiving a Siesta Key Bikinis Starter Kit, you agree to be bound by these Policies and Procedures.
Compensation
The ambassador will be paid up to 20% (or less depending on tier) of every sale generated through their promo code.
This percentage is subject to change by the Company at any time.
Swimwear and accessories are provided as compensation in exchange for brand related posts, content and item reviews. The items provided may be free or discounted. If an ambassador receives items from the company they are expected to post content in that/those item(s). If Ambassador does not post, tag, review and otherwise perform under the terms and conditions, company may decide to terminate relationship and ask for the return of any items that were not utilized. If AMBASSADOR does not return the items, they will be billed at full retail value by the company. Any unpaid balances after 7 days will be referred to collection agency.
The ambassador is solely responsible for any and all tax obligations.
Intellectual Property Rights
Ambassador content:
The ambassador grants the Company a worldwide, irrevocable, sub-licensable, non-exclusive license to use the content the ambassador creates and all content the company creates of the ambassador at photo and video shoots to promote the Company’s services, in any manner, in whole or in part, in perpetuity. This includes, but is not limited to, social media, advertising, publications, marketing material, or any other form of media. Additionally, the ambassador waives their right to inspect and decide which photos or video content can be used by the company.
The company content:
The company grants the ambassador a non-exclusive, non-transferable, revocable, limited license to use the Company's name, logo, slogans, promo codes, likeness, and other advertising material solely for the purpose of this ambassador agreement. The company retains all rights to their content.
Termination
The company may terminate the relationship with the ambassador at any time for any reason with or without cause.
The ambassador may terminate the relationship with the company with written notice of 30 days.
Exclusive Ambassador * Not active currently.*
An Ambassador can chooseto apply as an Exclusive Ambassador by contacting us and getting approval*.

What does this mean? While an ambassador of the Company, the ambassador may not promote or advertise competing products and brands. The ambassador agrees to post original created content to their Instagram Feed 2x per week + 2 Stories (including the tag @SiestaKeyBikinis) wearing Siesta Key Bikinis swimwear to promote the brand. Company will give ambassador an additional $75-$150+ (based on performance) in Siesta Key Bikinis Gift Cards each month to use towards new swimwear plus a higher exclusive commission tier.
*Approval based on Followers, Activity and Engagement by Followers and at sole discretion of the Company*
Liability Limitations
You expressly agree and understand that the Company shall not be liable to you or any third party for any direct, indirect, consequential or any other damages including, but not limited to, damages for loss of profit, goodwill, or other intangible losses resulting from the ambassador program.
